CENTER - A judge has appointed an attorney to represent the interests of a 3-month-old baby who is at risk of being removed from his adoptive parents' home.
Knox County District Court Judge Patrick Rogers has appointed Neligh attorney Jeffrey Doerr to represent Morgan Vesely, the infant, adopted son of Jason and Angela Vesely of rural Verdigre.
Rogers is scheduled to hold a hearing on Monday, Feb. 11, at 9 a.m. to consider a habeas corpus motion filed by the Nebraska Children's Home, which placed Morgan with the Veselys.
With the habeas corpus motion, the court will be asked to rule whether the Veselys are justified in continuing to care for Morgan.
About six weeks after the Veselys adopted Morgan, the Nebraska Children's Home began efforts to try to get Morgan back after it learned Mrs. Vesely became pregnant.
The Veselys said none of the contracts they signed nor discussions they had stated they could not adopt Morgan if Mrs. Vesely became pregnant.
Morgan was born Oct. 29, 2007. The Veselys' biological son, Gage Jaxon, was born Dec. 30, 2007, prematurely at 28 weeks.
Mrs. Vesely said from her home in rural Verdigre on Friday morning that Gage is doing well at a Sioux Falls, S.D., hospital.
"He's put on some weight," she said. "He's up to 3 pounds, 6 ounces when they weighed him last night."
Mrs. Vesely said a pretrial conference was held Thursday afternoon in Norfolk. At that conference, the Nebraska Children's Home sought to have the trial split into two questions, she said.
One is whether the placement was valid. Rogers took the Nebraska Children's Home motion under advisement, which means he has yet to rule.
As it stands currently, the case is scheduled to be heard Feb. 11 before Rogers, regardless of whether it is split into two parts.
Prior to Morgan's placement with the Veselys and the birth of Gage, the Veselys had been married more than 12 years. They experienced the loss of three babies, all of whom died shortly after birth.
While going through the adoption procedure for Morgan, Mrs. Vesely became pregnant again.
The Veselys, who are being represented by Norfolk attorney Kathleen Rockey, have described the the adoption, her pregnancy, the premature birth of Gage and attempts by the agency to get Morgan back as an "emotional roller coaster."
Mrs. Vesely said they appreciate all the support from the residents of Verdigre right from the beginning.
"We're all doing the best we can," Mrs. Vesely said. "We pray that the court will award Morgan to us on Feb. 11."

I have been out of touch with Jason and Angela for some years now, but I do know that they would give any child a wonderful home. I want you to know that I am praying for you and shame on the NCH for ripping a family apart. They would provide a great home, whether it be to 1 or 10 kids!! This quote was taken directly from the web site of Nebraska Children's Home. "The Nebraska Children's Home believes that adoption is a life-long process rather than a one-time event. Our agency is committed to providing assistance and support to all who were placed for adoption through the Nebraska Children's Home, as well as birth parents, adoptive parents, relatives and friends." Do we really feel they are providing the support and assistance to Jason & Angela as stated on their website. I think not. Jason & Angela met all the criteria necessary to be eligible to become adoptive parents, They have given Morgan a loving home with 2 parents and several grandparents living nearby to love & care for him. Too bad every child in Nebraska isn't as lucky.

What I don't understand is why NCH is trying to take the Vesely's daughter back. It's implied because Angela became pregnant but I think an article that's incomplete in such facts is just as bad as providing erroneous information.
If it is true that all of this is because Mrs. Vesely became pregnant, I would love to see how NCH will pull off demanding women give up their reproductive rights when not even the US Government can.
I can't even understand why this article was even allowed to print w/o each side representing the facts. Oddly, I can find no other information on this case anywhere else on the internet.
